Capital Gains Tax On Property, After The 2024 Changes

The Finance (No.2) Act 2024 substantially rewrote how property gains are taxed. The long-term rate fell from 20% to 12.5%, but indexation — which adjusted your purchase cost for inflation and often eliminated most of the taxable gain — was withdrawn.

For property acquired before 23 July 2024, you may choose whichever route produces the lower tax. Which one wins depends on how long you held and how much the property appreciated: modest appreciation over a long holding usually favours indexation, while sharp appreciation over a short holding favours the flat 12.5%.

Short Term Versus Long Term

Immovable property held for more than 24 months qualifies as long term. Held for 24 months or less, the gain is short term, added to your total income and taxed at your slab rate — which for most sellers means 30% plus surcharge and cess.

The difference is stark. A ₹40 lakh gain taxed at 12.5% costs ₹5 lakh; the same gain at a 30% slab costs ₹12 lakh. If you are approaching the 24-month mark, waiting is often the single most valuable thing you can do.

Short-term gains also cannot use the Section 54 exemption, so reinvestment offers no shelter.

Exemptions That Reduce The Bill

Section 54 requires the new house to be purchased within one year before or two years after the sale, or constructed within three years. If the return filing deadline arrives before you have reinvested, deposit the amount in a Capital Gains Account Scheme with a bank — otherwise the exemption is lost even if you buy later.

TDS On The Sale

Where the seller is resident and the consideration is ₹50 lakh or more, the buyer must deduct 1% TDS under Section 194-IA and deposit it using Form 26QB. This is on the sale value, not the gain, and is credited against your final tax liability.

Where the seller is an NRI, the position is entirely different. The buyer must deduct at 20% plus surcharge and cess on long-term gains under Section 195, and the deduction applies regardless of the sale value. NRIs facing a deduction far larger than their actual liability should apply for a lower deduction certificate under Section 197 before the transaction, since recovering excess TDS through a refund takes many months.

Frequently Asked Questions

Should I choose 12.5% without indexation or 20% with it?

Whichever is lower, if your property was acquired before 23 July 2024. The calculator computes both and shows the difference. As a rough guide, indexation usually wins where the property was held a long time and appreciated modestly, since the indexed cost climbs substantially. The flat 12.5% usually wins where appreciation was sharp relative to the holding period.

How is the holding period counted?

From the date of acquisition to the date of transfer. For property bought from a builder, the date of allotment is generally taken rather than the date of possession or registration, which can bring the 24-month mark forward considerably. For inherited property, the previous owner's holding period is included in yours, and their cost of acquisition becomes yours.

What can I add to my cost of acquisition?

The purchase price, stamp duty and registration charges, brokerage paid on purchase, and legal fees. Capital improvements such as an added room, a new bathroom or structural work also count as cost of improvement. Routine repairs, repainting and maintenance do not. Keep invoices — the burden of proving improvement cost sits with you.

Can I claim exemption on more than one property?

Section 54 normally allows reinvestment in one residential house. A once-in-a-lifetime option to reinvest in two houses exists where the capital gain does not exceed ₹2 crore. The ₹10 crore cap on the exemption applies regardless, so gains above that are taxable even if fully reinvested.

What if I sell at a loss?

A long-term capital loss on property can be set off against long-term capital gains from any asset, and carried forward for eight assessment years. A short-term loss can be set off against both short and long-term gains. You must file your return by the due date to carry a loss forward. Missing the deadline forfeits the carry-forward entirely.

Does the buyer deduct TDS from my payment?

For a resident seller, 1% under Section 194-IA where the consideration is ₹50 lakh or more, deposited via Form 26QB and credited against your liability. For an NRI seller, 20% plus surcharge and cess on long-term gains under Section 195, regardless of value. If that exceeds your actual liability, apply for a lower deduction certificate under Section 197 before completing the sale rather than waiting for a refund.
