Confirm the landlord actually owns it
Ask for the sale deed or the latest property tax receipt in the owner's name. Paying a deposit to someone who is not the owner, or not authorised to let it, is the single most damaging rental mistake.

Some RWAs require tenant registration and a no-objection process. Confirm this before committing, not after you have paid a token.

What exactly may be deducted, and what counts as normal wear and tear versus damage. A vague deposit clause is the leading cause of disputes at move-out.

Every wall, fixture and appliance, timestamped and shared with the landlord by message. This is the single best protection you have when you eventually vacate.

What To Check Before You Rent
Most rental disputes in India trace back to something that could have been caught in the first fifteen minutes of a viewing — an owner who could not produce a sale deed, a deposit clause with no definition of "damage," or a verbal promise about parking that was never written down.
None of this requires legal training. It requires asking the right questions before you pay a token, and getting the answers in writing rather than accepting them verbally.
Verifying The Property And The Owner

Ask for proof of ownership
A sale deed, or at minimum a recent property tax receipt in the owner's name. Someone letting a property they do not own or are not authorised to let is not a rare occurrence in NCR.

Confirm who you are actually dealing with
If a broker or property manager is handling the transaction, ask for written authorisation from the owner, and get the owner's direct contact details for the agreement itself.

Check the society's tenant policy
Some RWAs require tenant registration or a security deposit to the society itself, separate from the landlord's deposit. Confirm this before you commit.

Water pressure, noise and parking availability often look very different at 7pm than during a daytime viewing.
Protecting Your Deposit
Deposit disputes are the single most common friction point between landlords and tenants, and almost all of them come down to the same root cause: no dated record of the property's condition at handover.
Photograph every room, every fixture and every appliance the day you move in, and share those photos with the landlord by message so there is a timestamped record both sides hold. Do the same again the day you move out. This single habit resolves the overwhelming majority of deposit disagreements before they start.
Read the deposit clause in your agreement closely. It should define what may be deducted — unpaid dues, damage beyond normal wear — and should not leave "damage" undefined, since that ambiguity is where landlords and tenants disagree.
Frequently Asked Questions
How much deposit is normal in NCR?
Two to three months' rent is standard across Delhi NCR, Noida and Gurugram — meaningfully lower than Mumbai or Bengaluru. Anything materially above three months without a clear reason is worth questioning.
What can a landlord legally deduct from my deposit?
Unpaid rent, unpaid utility bills, and genuine damage beyond normal wear and tear. Fading paint, minor scuffs and ordinary carpet wear are not damage — a cracked fixture or a burnt countertop is. A well-drafted agreement defines this explicitly, which is exactly why the definition matters more than the deposit amount itself.
Can I negotiate the rent?
Yes, particularly if the property has been vacant for a while or you can commit to a longer lock-in. Landlords weigh the cost of an empty flat against a small reduction in rent, and a longer commitment from a tenant they trust is often worth more to them than the last few thousand rupees.
What should I do if the landlord refuses a written agreement?
Treat it as a serious warning sign. A written agreement protects both parties, so reluctance to sign one usually means the landlord wants flexibility to change terms later without your recourse. Do not proceed on a verbal understanding for anything beyond a very short stay.
Is police verification my responsibility as a tenant?
No — the legal obligation sits with the landlord in Delhi, Noida, Ghaziabad and Gurugram, and failure to complete it can attract a penalty on the landlord specifically. You should still cooperate promptly when asked for documents, since a landlord facing repeated delays may become reluctant to renew.
What if I need to leave before the notice period is up?
Check your agreement's notice and lock-in clauses. Leaving during a lock-in period typically means forfeiting rent for the remaining lock-in, often adjusted against the deposit. Talk to your landlord early — many will negotiate a shorter exit if you help find a replacement tenant, which saves them the cost of a vacancy too.
