The Rules That Matter Most

    What you may own

    Under FEMA, an NRI or OCI may acquire any residential or commercial property in India without RBI approval. Agricultural land, plantation property and farmhouses may not be purchased — only inherited.

    Payment must come through normal banking channels from an NRE, NRO or FCNR account, or by inward remittance. Travellers cheques and foreign currency cash are not permitted.

Indian Property For NRIs And OCIs

Buying, holding and selling Indian property as a non-resident is governed by FEMA on the exchange control side and the Income Tax Act on the tax side. Neither is especially complicated, but the two interact, and the points that catch people out are consistently the same: the 20% TDS on sale, the repatriation paperwork, and Powers of Attorney executed incorrectly abroad.

What follows covers the rules that most often affect overseas owners in practice.

What You May And May Not Buy

Under FEMA, an NRI or OCI may acquire any residential or commercial immovable property in India without RBI approval, and there is no limit on the number of properties.

Agricultural land, plantation property and farmhouses may not be purchased. They may only be acquired by inheritance, and a foreign national who is not an OCI generally cannot buy at all without RBI permission.

Payment must come through normal banking channels — an inward remittance, or from an NRE, NRO or FCNR account. Foreign currency cash and travellers cheques are not permitted, and a purchase funded that way creates a problem that surfaces at sale.

The TDS Problem When You Sell

When a buyer purchases from a resident seller, TDS is 1% of the sale value. When the seller is an NRI, the buyer must deduct under Section 195 at 20% plus surcharge and cess on long-term gains — and critically, this applies regardless of the sale value, with no ₹50 lakh threshold.

Worse, buyers and their advisors frequently apply the rate to the entire sale consideration rather than to the gain, because that is the safe course for them. On a ₹2 crore sale with a ₹40 lakh gain, that is the difference between about ₹5 lakh and over ₹40 lakh withheld.

The remedy is to apply for a lower or nil deduction certificate under Section 197 before the transaction completes. It takes several weeks, so start early. Recovering excess TDS through a refund after filing takes many months and ties up capital you probably intended to repatriate.

Power Of Attorney From Abroad

Most NRI transactions rely on a Power of Attorney because the owner cannot attend registration. Executing it correctly matters, because a defective PoA is discovered at the sub-registrar with the buyer waiting.

Two valid routes exist. Sign before an official at the Indian embassy or consulate in your country of residence, which requires no further attestation. Or sign before a local notary and have the document apostilled under the Hague Convention if your country is a signatory.

Either way, the PoA must then be stamped in India within three months of receipt, and it must be registered if it grants the power to sell. A specific PoA naming the property and the exact powers granted is far safer than a general one, which gives the holder authority you may not intend.

Can an NRI buy agricultural land in India?

No. NRIs and OCIs may buy residential and commercial property freely, but agricultural land, plantation property and farmhouses cannot be purchased. They can be inherited, and can be held if acquired while you were resident. Selling inherited agricultural land is generally only permitted to a resident Indian citizen.

How much can I repatriate after selling?

Up to USD 1 million per financial year from an NRO account, with Form 15CA from you and Form 15CB from a chartered accountant. Where the property was purchased using funds remitted from abroad or from an NRE account, sale proceeds of up to two residential properties may be repatriated without counting against that limit.

Do I have to file an Indian tax return?

If you have income arising in India — rent, capital gains, interest — above the basic exemption limit, yes. It is also usually in your interest even when not strictly required. TDS on NRI rent is deducted at 31.2% and on sale at 20% plus surcharge, both frequently well above actual liability after deductions. Filing is how you recover the excess.

Can I take a home loan in India as an NRI?

Yes. Most Indian lenders offer NRI home loans, generally at the same rates as residents, with repayment through NRE or NRO accounts or by inward remittance. Tenure is typically shorter, LTV slightly lower, and documentation heavier — passport, visa, overseas employment contract, salary slips and often an attested Power of Attorney for someone in India to act on your behalf.

What TDS applies to rent I receive?

A tenant paying rent to an NRI landlord must deduct TDS at 31.2% under Section 195, and deposit it against your PAN. This is far higher than the 2% that applies when the landlord is resident. Many tenants are unaware of this and the liability for failure sits with them, so it is worth addressing explicitly in the rent agreement. After the 30% standard deduction on rental income, your actual liability is usually well below the TDS, making a refund available on filing.

Does OCI status change anything?

For property purposes, OCI cardholders are treated substantially the same as NRIs under FEMA — the same freedom to buy residential and commercial property, and the same prohibition on agricultural land. Tax treatment depends on your residential status for the relevant year under the Income Tax Act, which is determined by days of physical presence in India, not by your citizenship or OCI card.
