Difference Between Agreement to Sale and Sale Deed
An Agreement to Sale (ATS) is an agreement promising to transfer property in the future upon satisfaction of agreed terms (e.g. loan disbursement, possession). It creates a right to obtain another document.
A Sale Deed is the actual conveyance instrument that transfers absolute ownership rights from seller to buyer immediately upon registration at the Sub-Registrar Office.

Why do I need an independent lawyer when the builder provides standard agreements?
Builder-drafted agreements are inherently one-sided, often containing penal interest rates for buyer payment delays, clauses permitting builders to unilaterally alter layouts, extended grace periods, and restrictive refund terms. An independent advocate protects your interests and negotiates protective addendums.
What is Property Mutation and why is it necessary after registration?
Registration of a Sale Deed establishes ownership between buyer and seller. Mutation (Khata / Dakhil Kharij) transfers the title in local municipal and revenue records for property tax billing and civic utilities. Without mutation, property tax receipts will continue in the previous owner’s name.
Is a General Power of Attorney (GPA) valid for selling property in India?
No. In the landmark judgment Suraj Lamp & Industries v. State of Haryana (2011), the Supreme Court ruled that a General Power of Attorney is not an instrument of conveyance. Immovable property can only be lawfully transferred via a registered Sale Deed.
