A property may appear physically complete and possess clean-looking paperwork, yet be embroiled in a silent court dispute, debt recovery tribunal proceeding, or developer insolvency case that freezes ownership transfers indefinitely.
Under the doctrine of "Lis Pendens" (Section 52 of the Transfer of Property Act, 1882), any property transaction executed while a court suit is pending is legally subordinate to the final court judgment. If the seller loses the lawsuit, the buyer loses their entire ownership claim.

Understanding NCLT Insolvency Risks for Home Buyers
Under the Insolvency and Bankruptcy Code (IBC), 2016, home buyers are recognized as "financial creditors in a class". However, if an insolvency application is admitted against a builder, a statutory moratorium immediately takes effect: all ongoing construction halts, bank accounts freeze, and control passes to an Interim Resolution Professional (IRP).
Purchasing a flat in an NCLT-admitted project without Resolution Professional clearance is legally invalid and leaves the buyer with no immediate possession rights.

What is Lis Pendens in property transactions?
Lis Pendens (Section 52, Transfer of Property Act) states that transfer of property under active litigation cannot prejudice the rights of any party under the court decree. If you buy a property involved in an active lawsuit, you are bound by whatever judgment the court delivers, even if you were unaware of the suit.
How do I check if a builder has cases in NCLT?
You can search the official NCLT portal (nclt.gov.in) and IBBI portal (ibbi.gov.in) using the builder’s registered company name and Corporate Identification Number (CIN) to verify whether any Section 7 or Section 9 CIRP petitions are admitted.
Can a property with a pending RERA complaint be sold?
Yes, unless the RERA authority has issued an explicit interim restraining order or Attachment Order on the specific unit or bank accounts of the promoter.
What is a Recovery Certificate (RC) issued by RERA?
When a promoter fails to refund money or pay delay compensation ordered by RERA, the authority issues a Recovery Certificate to the District Magistrate (DM) to recover the amount as arrears of land revenue through bank account attachment or property auction.
